New York Health Insurance Basics

Start here for how coverage works in New York. These answers cover where to shop, who regulates plans and how prices are set.

❓ Where do New Yorkers buy marketplace health insurance?

Quick answer

New Yorkers use NY State of Health, the state's official marketplace. HealthCare.gov does not sell plans for New York.

NY State of Health handles private plans, the Essential Plan, Child Health Plus and most Medicaid. You can apply online, by phone at 1-855-355-5777 or with a navigator. One application checks every program at once.

❓ How many New Yorkers buy private plans on NY State of Health?

Quick answer

About 210,000 New Yorkers picked a private marketplace plan during the most recent Open Enrollment, according to KFF.

That number is small for a large state. The reason is that Medicaid and the Essential Plan cover many lower-income adults. As a result, private plans mainly serve middle- and higher-income households.

❓ Who regulates health insurance in New York?

Quick answer

The New York State Department of Financial Services, or DFS, regulates health insurers and reviews their rates.

DFS also runs external appeals and the surprise bill dispute process. Its consumer line is 1-800-342-3736. Meanwhile, self-funded employer plans follow federal rules instead.

❓ How many New Yorkers lack health insurance?

Quick answer

About 4.9% of New Yorkers were uninsured in the latest KFF data. That is well below the U.S. rate of 8.2%.

Low-cost public programs help keep that rate down. In fact, Medicaid, the Essential Plan and Child Health Plus all accept applications year-round. So, anyone without coverage should check eligibility before assuming they cannot afford it.

❓ Is there a penalty for not having health insurance in New York?

Quick answer

No. New York does not have a state individual mandate or tax penalty.

The federal penalty is also $0. However, going uninsured leaves you exposed to large medical bills. In addition, most people can only buy private plans during Open Enrollment or after a life event.

❓ Do New York health insurance prices depend on age?

Quick answer

No. New York uses community rating, so your age and health do not change your premium.

A 60-year-old pays the same price as a 25-year-old for the same plan in the same region. Instead, prices vary by region, plan and family size. That helps older buyers, though younger adults may pay more than in other states.

❓ Can Vivna help me with New York health insurance?

Quick answer

Vivna does not currently sell or enroll health plans for New York residents. However, our licensed agents are glad to answer general questions.

For enrollment, use NY State of Health or a certified New York navigator or broker. Navigator help is free. If you move to a state where Vivna sells, we can quote plans there.

NY State of Health Open Enrollment and Special Enrollment

New York keeps several programs open all year. These answers cover private plan deadlines, renewals and life events.

❓ When is Open Enrollment for health insurance in New York?

Quick answer

Open Enrollment for private NY State of Health plans starts November 1. It currently runs through January 31.

Plans picked by mid-December usually start January 1. Later choices typically start February 1. Check NY State of Health each fall for the exact deadlines.

❓ Which New York programs accept applications all year?

Quick answer

Medicaid, the Essential Plan and Child Health Plus accept applications any time. Private plans require Open Enrollment or a life event.

That is a big advantage for low- and moderate-income families. American Indians and Alaska Natives can also enroll in any program at any time. So, apply as soon as income drops or a child loses coverage.

❓ Can I buy a private plan in New York after Open Enrollment ends?

Quick answer

Yes, if you have a qualifying life event. You generally must report it within 60 days.

Proof may be required, such as a letter showing lost coverage. Moves and marriages also require other coverage in the prior 60 days. Otherwise, check whether you qualify for a year-round program.

❓ What counts as a qualifying life event in New York?

Quick answer

Losing coverage, moving into the state, marriage, divorce, a new child and a certified pregnancy all qualify.

New York lists pregnancy certified by a health care practitioner as a life event. Becoming a citizen or lawfully present also counts. So does a change in eligibility for financial help.

❓ Will my New York health plan renew automatically?

Quick answer

Most members renew through NY State of Health, which sends a notice when you need to act.

Log in each fall to review your income, household and plan. Prices and networks can change at renewal. You can also text START to 1-866-988-0327 for deadline reminders.

❓ What happens if I miss Open Enrollment in New York?

Quick answer

Without a life event, you usually wait for the next Open Enrollment to buy a private plan.

However, you can still apply for Medicaid, the Essential Plan or Child Health Plus any time. There is no state tax penalty for the gap. Even so, a gap can leave you with big bills.

❓ When does coverage start after a special enrollment in New York?

Quick answer

In most cases, coverage starts the first day of the month after you choose a plan.

Some events follow different rules. For example, coverage for a new baby can start on the birth date. Pay your first premium on time so the plan takes effect.

New York Health Insurance Subsidies and Costs

New York adds state savings on top of federal tax credits. These answers explain who qualifies, special silver plans and rate changes.

❓ How do health insurance subsidies work in New York?

Quick answer

Federal premium tax credits lower private plan premiums on NY State of Health. They are based on income, household size and location.

You can take credits monthly or claim them at tax time. Credits are only available through NY State of Health. Meanwhile, lower-income adults may get the Essential Plan, which has no premium.

❓ Who qualifies for premium tax credits in New York?

Quick answer

Lawfully present residents who earn above Essential Plan limits and up to 400% of poverty generally qualify.

That upper limit is currently about $63,840 for one person and $132,000 for a family of four. Affordable job-based coverage can block credits. Also, federal rules now limit which immigrants can get credits.

❓ Is there a subsidy cliff for health insurance in New York?

Quick answer

Yes. Federal premium tax credits stop for households earning above 400% of the poverty level.

The enhanced credits that removed the cliff expired and were not extended. As a result, households just above the line pay full price. Compare bronze and silver options carefully before you renew.

❓ What are Silver Supreme and Silver Enhanced plans in New York?

Quick answer

They are New York silver plans with lower deductibles and copays for eligible middle-income buyers.

Silver Supreme currently serves individuals earning up to about $54,775. Silver Enhanced serves incomes just above that, up to about $62,600. To get these savings, you must choose a silver plan.

❓ How many New Yorkers get help paying private plan premiums?

Quick answer

In the latest federal data, about 59% of New York marketplace enrollees received premium tax credits.

That share is lower than in many states. Many lower-income adults use the Essential Plan instead, which this figure does not count. About 18% of enrollees also got extra cost-sharing help.

❓ Are New York health insurance rates going up?

Quick answer

Yes, but by less than insurers asked. DFS approved an average 6.0% increase for individual plans, versus 20.6% requested.

DFS says the cuts save consumers an estimated $324 million. Still, changes vary by insurer and region. Review your options before you renew.

❓ Do I have to pay back a subsidy in New York?

Quick answer

Possibly. If your income ends up higher than you estimated, you may repay extra credit at tax time.

Federal repayment caps were removed for most people. So, report income changes to NY State of Health promptly. That keeps your monthly credit accurate.

❓ Does New York cap costs for insulin and other key care?

Quick answer

Yes. New York has eliminated out-of-pocket costs for insulin, inhalers and lung cancer screenings, according to DFS.

Marketplace plans also list $0 out-of-pocket costs for most diabetes services. Most prenatal and postpartum services carry $0 costs as well. Check your plan summary for exact details.

New York Medicaid, Essential Plan and Child Health Plus

New York's public programs cover millions of residents. These answers explain income limits, the Essential Plan and coverage for children.

❓ Did New York expand Medicaid?

Quick answer

Yes. New York covers adults earning up to 138% of poverty, currently about $22,025 for one person.

For a family of four, the limit is about $45,540. Medicaid has no monthly premium, and yearly copays are capped at $200. In addition, most managed care members pay only small pharmacy copays.

❓ What is the Essential Plan in New York?

Quick answer

The Essential Plan is New York's low-cost plan for adults 19 to 64 who earn too much for Medicaid. It currently has a $0 premium and a $0 deductible.

Income must be up to about $31,920 for one person or $66,000 for a family of four. Dental and vision care are included. Best of all, you can enroll any time of year.

❓ Did the Essential Plan change in New York?

Quick answer

Yes. Federal funding cuts ended the expanded Essential Plan for people earning between 200% and 250% of poverty.

Those members need other coverage, such as a private plan with tax credits. NY State of Health posts fact sheets on the change. For case questions, call NY State of Health at 1-855-355-5777.

❓ Does New York Medicaid have work requirements?

Quick answer

Yes, for some adults. New federal rules require certain Medicaid members to meet work or activity rules to keep coverage.

The federal rule calls for 80 hours a month of activity or at least $580 in monthly earnings. NY State of Health is notifying affected members about the new rules. Watch your mail and online account for notices. People who lose Medicaid this way cannot get federal tax credits instead.

❓ What is Child Health Plus in New York?

Quick answer

Child Health Plus is New York's CHIP program for children under 19 who do not qualify for Medicaid. It has no deductible and no copays.

Coverage is free for a family of four earning up to about $73,260. Above that, premiums run $15 to $60 per child each month, capped at three children. Families above about $132,000 can still buy in at full premium.

❓ What are the Medicaid income limits for children in New York?

Quick answer

Children ages 1 to 18 qualify for Medicaid up to 154% of poverty. Infants under 1 qualify up to 223%.

For a family of four, that is about $50,820 for older children. Kids above Medicaid limits can move to Child Health Plus. Both programs include dental and vision care.

❓ Does New York Medicaid cover pregnancy?

Quick answer

Yes. Pregnant people qualify up to 223% of poverty, or about $73,590 for a family of four.

Coverage includes prenatal care, delivery and postpartum care. Pregnancy is also a qualifying life event for private plans in New York. That lets you change coverage mid-year if needed.

❓ Can I have a private plan while my kids are on Child Health Plus?

Quick answer

Yes. Many families mix programs, such as parents on a private plan and kids on Child Health Plus.

One NY State of Health application sorts each person into the right program. However, children with other insurance cannot use Child Health Plus. Update income changes for everyone in the household.

New York Health Insurance Carriers and Networks

Carrier choices in New York depend heavily on your region. These answers cover insurers, plan types and how to check your doctors.

❓ Which carriers sell plans on NY State of Health?

Quick answer

About a dozen insurers file individual plans in New York. Names include Fidelis Care, Healthfirst, EmblemHealth, MetroPlus, Oscar and UnitedHealthcare.

Blue plans include Anthem, Excellus BlueCross BlueShield and Highmark. Regional carriers include CDPHP, Independent Health and MVP Health Care. Your county decides which ones you see.

❓ Do plan choices differ between New York City and upstate?

Quick answer

Yes, New York City buyers often see Healthfirst, MetroPlus and EmblemHealth. Upstate buyers often see Excellus, CDPHP, MVP or Independent Health.

Network size also differs by region. In some rural counties, choices are limited. Therefore, compare networks carefully before you pick a plan.

❓ Are there PPO health insurance plans in New York?

Quick answer

They are uncommon. Most New York individual plans use HMO or EPO networks.

A few insurers offer out-of-network coverage in some regions, usually at a higher price. HMOs and EPOs keep costs lower by limiting the network. Check each plan's network type before you enroll.

❓ How do I check if my doctor is in a New York plan's network?

Quick answer

Search the carrier's directory for the exact plan name, then call the office to confirm.

Ask whether the doctor takes that specific plan, not just the carrier. Also confirm your hospital and specialists. In-network care saves you the most money.

❓ Which hospital systems matter most in New York health insurance networks?

Quick answer

People often ask about NewYork-Presbyterian, Mount Sinai, NYU Langone, Northwell Health and Montefiore. Upstate, they ask about University of Rochester Medical Center and Albany Med.

Academic medical centers are not in every plan's network. Even within one carrier, networks can differ by plan. Always confirm before you enroll.

❓ Do Oscar and UnitedHealthcare sell health insurance in New York?

Quick answer

Yes. Both currently file individual health plans in New York.

Availability depends on your county. Check each plan's network and drug list before you choose. Vivna can answer general questions about either carrier, even though we do not enroll New York plans.

❓ Does it cost more to enroll through a broker in New York?

Quick answer

No. Premiums are the same whether you enroll alone, with a navigator or with a broker.

Navigators are certified by NY State of Health and help for free. Brokers are paid by insurers. Either way, the price of the plan does not change.

New York Short-Term Health Insurance Rules

Short-term medical plans are not sold in New York. These answers explain why and what to use during a coverage gap.

❓ What can I use instead of short-term insurance in New York?

Quick answer

Year-round programs often fill the gap. Medicaid, the Essential Plan and Child Health Plus accept applications any month.

Losing job coverage also opens a 60-day window for a private plan. COBRA lets you keep your employer plan for a time. Compare its full price with programs on NY State of Health.

❓ Do New York plans cover pre-existing conditions right away?

Quick answer

Yes. Every New York individual plan covers pre-existing conditions as soon as coverage starts.

Insurers cannot deny you or charge more because of your health. New York also does not charge more by age. That consumer focus is a key reason short-term plans are not sold here.

❓ Are tri-term health plans available in New York?

Quick answer

No. Tri-term plans are a type of short-term coverage, so they are not sold in New York.

Vivna offers tri-term plans only in approved states. New Yorkers who need longer coverage should use NY State of Health. Its programs meet ACA standards.

❓ Where does Vivna offer short-term health insurance?

Quick answer

Vivna offers UnitedHealthcare short-term plans only in approved states, such as Pennsylvania. New York is not one of them.

Rules for plan length and benefits differ in each approved state. If you move to one, an agent can review short-term options there. Until then, NY State of Health is your best path.

New York Surprise Bills, Appeals and Your Rights

New York has some of the nation's oldest surprise bill protections. These answers cover surprise bills, dispute resolution, appeals and complaints.

❓ Does New York protect me from surprise medical bills?

Quick answer

Yes. New York law limits you to in-network costs for emergency care and most surprise bills.

For state-regulated plans, out-of-network emergency hospital care costs only your in-network copay, coinsurance or deductible. The same applies to qualifying surprise bills. Federal law covers most self-funded employer plans.

❓ What counts as a surprise bill in New York?

Quick answer

A bill from an out-of-network provider at an in-network hospital or surgery center can qualify. So can certain out-of-network care tied to an in-network referral.

It is usually not a surprise bill if you knowingly chose an out-of-network provider. The same applies if you could choose in-network care 72 hours ahead. Send the DFS Surprise Medical Bill Certification Form to your plan and provider.

❓ What is New York's independent dispute resolution process?

Quick answer

It is a DFS process that settles out-of-network bill disputes between providers and insurers. Uninsured patients can also dispute some bills.

Insured patients are held to in-network amounts for protected services. Uninsured patients may owe a fee of up to $495 if the bill is upheld. That fee is waived for incomes below 250% of poverty.

❓ How do I appeal a denied health insurance claim in New York?

Quick answer

First, file an internal appeal with your plan. If the plan upholds the denial, you can request an external appeal through DFS.

You have 4 months after the final internal decision to file. Standard decisions come within 30 days, and expedited ones within 72 hours. Keep copies of all letters.

❓ How does external appeal work in New York?

Quick answer

DFS assigns your case to an independent external appeal agent. The agent's decision is binding on you and your plan.

Plans may charge $25 per appeal, up to $75 a year. That fee is waived for hardship and for Medicaid and Child Health Plus members. Urgent non-formulary drug appeals are decided within 24 hours.

❓ How do I file a health insurance complaint in New York?

Quick answer

File a complaint with DFS online or call 1-800-342-3736. Program questions go to NY State of Health at 1-855-355-5777.

Include your member ID, claim numbers and copies of letters. DFS handles billing, claim and coverage complaints. Self-funded employer plans may need a federal complaint instead.

❓ What benefits must New York health plans cover?

Quick answer

All individual plans cover the 10 essential health benefits, including preventive care, prescriptions, maternity and mental health care.

Children's dental and vision care are included. In-network preventive services carry no copay. Plus, standard plan designs make side-by-side comparison easier.

New York Dental, Vision and Supplemental Plans

Extra coverage can fill gaps in a health plan. These answers cover dental, vision, supplemental and life insurance questions in New York.

❓ Can I buy dental and vision insurance in New York any time?

Quick answer

Standalone plans sold directly by carriers can often be bought any month. Marketplace dental follows Open Enrollment and life event rules.

Waiting periods may apply to major dental work. Compare annual maximums before you buy. Vivna does not sell dental plans to New York residents, but we can answer questions.

❓ Do New York marketplace plans include adult dental?

Quick answer

Some do. Children's dental is included in every plan, and some plans also cover adult dental.

You can also add a standalone dental plan through NY State of Health. The Essential Plan includes dental and vision for adults. Check each plan's dental details before you choose.

❓ Is vision coverage included in New York health plans?

Quick answer

For children, yes. Essential Plan members also get vision care, while private plan buyers may need a separate vision plan.

Pediatric vision is an essential health benefit. Standalone vision plans usually cover a yearly exam and an eyewear allowance. Compare costs against your expected use.

❓ What supplemental plans can New Yorkers add to health insurance?

Quick answer

Accident, critical illness and hospital indemnity plans pay cash benefits on top of health insurance.

They help with deductibles, travel and lost income. However, they do not replace major medical coverage. Check that any plan is approved for sale in New York.

❓ Does supplemental insurance count as health coverage in New York?

Quick answer

No. Supplemental plans are not minimum essential coverage.

New York has no state mandate, but you still need real coverage for big bills. So, pair any supplemental plan with a full health plan. That way, cash benefits fill gaps instead of carrying all the risk.

❓ Does Vivna sell life insurance in New York?

Quick answer

Not at this time. Vivna does not currently sell life or health plans to New York residents.

Our agents can still explain how term and whole life insurance work. For a policy, contact a New York licensed agent. Our life insurance guides are also a good place to start.

New York Health Insurance for Your Situation

Your job, age and life stage shape your best option. These answers cover self-employment, gig work, young adults, early retirement, job loss, families, students and new residents.

❓ What health insurance can self-employed New Yorkers buy?

Quick answer

Most buy a private plan or the Essential Plan through NY State of Health, based on income.

Net self-employment income drives your eligibility. You may also deduct premiums on your tax return. Estimate income carefully to avoid repaying credits.

❓ What coverage options do New York gig and delivery workers have?

Quick answer

Most app-based workers get coverage through NY State of Health. Low or uneven income can qualify you for Medicaid or the Essential Plan.

Report income changes promptly, since eligibility depends on income. The Essential Plan accepts applications all year. Private plans, however, follow Open Enrollment rules.

❓ Can young adults stay on a parent's plan in New York?

Quick answer

Yes, until age 26 under the ACA. New York also lets some young adults up to 29 buy into a parent's employer plan.

This Young Adult Option generally applies to insured employer plans, not self-funded ones. The young adult usually pays the full premium. Compare it with the Essential Plan or a private plan.

❓ What are my health insurance options if I retire early in New York?

Quick answer

Early retirees often choose COBRA, a NY State of Health plan or the Essential Plan until Medicare.

Eligibility depends on income, not savings. Because New York does not price by age, private plans cost the same at 62 as at 30. Watch the 400% cliff as you draw retirement income.

❓ What happens to my health insurance if I lose my job in New York?

Quick answer

Losing job coverage gives you 60 days to choose a private plan. Lower income may also qualify you for Medicaid or the Essential Plan right away.

COBRA or state continuation can keep your current plan, often at full cost. Compare that price with programs on NY State of Health. Apply quickly to avoid a gap.

❓ How much does family health insurance cost in New York?

Quick answer

It depends on region, plan and income, not on age. Many families combine Child Health Plus with a private plan or the Essential Plan.

Child Health Plus is free or low-cost for most families. Tax credits currently reach families of four earning up to about $132,000. A navigator can price every option for you.

❓ Can college students get health insurance in New York?

Quick answer

Yes. Students can use a parent's plan until 26, a campus plan or NY State of Health coverage.

Students with low income may qualify for Medicaid or the Essential Plan. Out-of-state students should check whether a parent's network works in New York. Compare costs before you waive a campus plan.

❓ I just moved to New York. Can I get health insurance now?

Quick answer

Yes. A permanent move into New York opens a 60-day window for a private plan.

You generally need other coverage in the 60 days before the move. Meanwhile, Medicaid, the Essential Plan and Child Health Plus are open all year. Apply right away if your income is modest.
