Privacy Policy

Vivna Inc., doing business as Vivna Insurance (“Vivna,” “we,” “us,” or “our”), is a licensed independent health insurance brokerage based in Deerfield Beach, Florida. This Privacy Policy explains what information we collect, how we use and share it, how we communicate with you by phone, text message, and email, and the choices you have. It applies to vivna.net, to the quotes and enrollment services we provide, and to every call, text, and email exchanged with our agents.

Information We Collect

Information you give us. When you request a quote, complete a form, apply for coverage, or speak with an agent, we collect the information needed to find and enroll you in a plan. This may include:

  • Name, mailing address, email address, and phone number
  • Date of birth, gender, and household size, including the names and dates of birth of dependents you want to cover
  • ZIP code, county, and state of residence
  • Estimated household income, used only to check possible Marketplace eligibility
  • Current coverage, tobacco use, and general health questions a carrier requires to quote or issue a policy
  • Preferred doctors or providers, so we can check network participation
  • Social Security number, when a carrier or the Health Insurance Marketplace requires it to complete an application
  • Payment information you provide to a carrier to bind coverage. Vivna does not store full payment card or bank account numbers.

Information collected automatically. When you visit vivna.net, we collect limited technical data such as IP address, browser and device type, pages viewed, referring website, and approximate location derived from your IP address. See the Cookies section below.

Information from other sources. We receive information from insurance comparison websites, lead-generation companies, and marketing partners when you request a quote through one of their sites. We also receive policy status, effective dates, and commission information from the carriers and third-party administrators that issue your coverage. See the Third-Party Websites section below.

How We Use Your Information

  • To prepare quotes and compare plans from the carriers we represent
  • To submit applications and enroll you in coverage you select
  • To verify your identity when you contact us about an existing policy
  • To provide customer service, including ID cards, billing questions, plan changes, dependent additions, and cancellations
  • To contact you by phone, text, or email about your quote, application, or policy, and about coverage options that may fit your needs
  • To maintain required insurance records and comply with state and federal law
  • To improve our website, services, and agent training
  • To detect fraud and protect the security of our systems

Phone Calls and Call Recording

Consent to be called. When you request a quote from Vivna, from one of our marketing partners, or by calling us, you agree that Vivna and its licensed agents may contact you at the phone number you provided, including by automated dialing technology and prerecorded or artificial voice messages, to discuss insurance products and services. Consent is not a condition of purchase. Message and data rates may apply to calls received on a mobile phone.

Call recording. Calls with Vivna may be monitored and recorded for quality assurance, training, compliance, and to document your enrollment decisions. Our agents disclose recording at the start of each call. If you do not wish to be recorded, tell the agent and we will end the call and follow up by another method.

Opting out of calls. You may ask us to stop calling at any time by telling any agent, by emailing memberservices@vivna.net, or by calling 888-730-6001. We add your number to our internal Do Not Call list within 24 hours and honor the National Do Not Call Registry. Vivna maintains a written Do Not Call policy, available on request.

Text Messaging (SMS)

If you opt in to text messages from Vivna Insurance, you may receive appointment and callback reminders, quote and enrollment updates, and customer service messages. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel and HELP for assistance. Full program terms are in our Terms of Service. When you opt in, we collect your name and mobile phone number, along with the details you provide when requesting a quote or enrolling, and use them to send you the messages described above.

SMS privacy. Vivna Insurance does not share your SMS opt-in consent with any third parties. Mobile phone numbers and text messaging consent collected for SMS will not be shared with or sold to third parties or affiliates for marketing purposes. Mobile information is used only to deliver the messages described above and is not shared through this SMS channel for any other purpose.

Email Communications

We send email to follow up on quotes, deliver documents, service your policy, and share coverage options and open-enrollment reminders. Every marketing email includes an unsubscribe link, and we process opt-out requests within 10 business days as required by the CAN-SPAM Act. Unsubscribing from marketing email does not stop transactional messages about a policy you hold, such as billing notices or ID card delivery.

How We Share Your Information

Vivna does not sell your personal information. We share it only as needed to provide insurance services and run our business:

  • Insurance carriers, third-party administrators, and the Health Insurance Marketplace, to quote, issue, and service your coverage
  • Service providers that operate on our behalf, including our telephone and text-messaging platform, customer relationship management system, agency management system, email hosting, website hosting, and analytics providers. These providers may use your information only to perform services for Vivna.
  • Licensed agents and staff of Vivna who need the information to assist you
  • Regulators, law enforcement, and courts when required by law, subpoena, or to protect the rights and safety of Vivna, our clients, or the public
  • A successor in the event of a merger, acquisition, or sale of Vivna’s assets, subject to this Privacy Policy

We do not share your information with unrelated companies for their own marketing.

Information From Third-Party Websites and Marketing Partners

Vivna works with insurance comparison websites and marketing partners that collect quote requests from consumers and pass them to licensed agencies like ours. When you submit a request on one of those sites and agree to be contacted, that site shares your information with Vivna, and a Vivna agent may call, text, or email you. Those websites operate under their own privacy policies and are responsible for the consent they collect. If you believe you were contacted in error, tell us and we will stop contact and note the source.

Cookies and Website Analytics

vivna.net uses cookies and similar technologies to keep the site working, remember your preferences, measure traffic, and understand which pages and campaigns bring visitors to us. We use Google Analytics and may use advertising platforms that set cookies for measurement and, where enabled, targeted advertising. You can control cookies through your browser settings, and you can opt out of Google Analytics at tools.google.com/dlpage/gaoptout. Disabling cookies may limit some site features.

Data Security and Retention

We protect your information with administrative, technical, and physical safeguards, including encrypted connections, access controls limited to staff who need the information, and restricted editing of sensitive fields such as Social Security numbers in our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We keep client records, call recordings, and consent records for as long as needed to service your policy and to meet state insurance record-keeping requirements, which generally run five years or longer after a policy ends. Quote requests that do not result in coverage are kept for a shorter period consistent with our compliance obligations, then deleted or anonymized.

Financial and Health Information (GLBA and HIPAA)

As an insurance agency, Vivna is subject to the privacy provisions of the Gramm-Leach-Bliley Act (GLBA) and related state insurance privacy regulations. We collect nonpublic personal information only to provide the insurance products you request, we do not disclose it except as permitted by law and described in this policy, and we maintain safeguards to protect it.

Vivna is not a covered entity under HIPAA. We do not maintain medical records. Health information you share to obtain a quote or complete an application is transmitted securely to the carrier and used only for that purpose. Claims and medical information are handled by your carrier, not by Vivna.

Your Privacy Rights

Depending on where you live, you may have the right to:

  • Know what personal information we collect and how we use and share it
  • Access a copy of your personal information
  • Correct inaccurate information
  • Request deletion, subject to insurance record-keeping laws that require us to retain certain records
  • Opt out of targeted advertising or the sale or sharing of personal information (Vivna does not sell personal information)
  • Appeal a denied request in states that provide an appeal process

To exercise these rights, email memberservices@vivna.net or call 888-730-6001. We will verify your identity before acting on a request and respond within the time required by your state’s law, generally 45 days. You will not be treated differently for exercising your rights.

California Residents

Under the California Consumer Privacy Act (CCPA/CPRA), California residents have the rights listed above plus the right to limit the use of sensitive personal information. In the past 12 months, Vivna has collected the categories of information described in “Information We Collect” and shared them for the business purposes described in “How We Share Your Information.” Vivna does not sell personal information and does not share it for cross-context behavioral advertising as defined by California law. Much of the information we collect is exempt from the CCPA because it is governed by GLBA; this section applies to any information that is not exempt.

Do Not Sell or Share My Personal Information: Because Vivna does not sell or share personal information, no opt-out is required. You may still confirm this or submit a request using the contact information below.

Children

Our services are intended for adults. We collect information about minors only when a parent or guardian provides it to add a dependent to coverage. We do not knowingly collect information directly from anyone under 18.

Our site links to carrier websites, provider directories, the Health Insurance Marketplace, and other resources. Those sites have their own privacy policies, and we are not responsible for their practices.

Changes to This Policy

We update this Privacy Policy when laws, technology, or our practices change. The revised version is posted on this page with a new “Last updated” date. Material changes may also be communicated by email.
